In accordance with the Surface Transportation Board’s merger rules, the Board has conditionally accepted Union Pacific and Norfolk Southern Corporation’s revised application, subject to additional information to be provided.
According to the Board’s decision, it will require Union Pacific and Norfolk Southern Corporation to supplement their Revised Application by July 27, 2026, with information on enhancing competition; access for 2-to-1-shippers and 3-to-2-shippers; service assurance plan; issues involving gateways and car supply; market share projections; downstream merger impacts; passenger rail; and workpaper issues. Given the order for supplemental information, the Board did not provide a procedural schedule.
The National Grain and Feed Association released the following statement: “As the process moves forward, the National Grain and Feed Association (NGFA) will continue to examine the application and gather feedback and perspectives from its members to help determine what position, if any, it will take in this matter. NGFA has consistently maintained that any agreement must deliver tangible benefits for rail customers and the agricultural supply chain. NGFA looks forward to future engagement with the Surface Transportation Board and the applicants in this matter.”

NGFA’s approximately 700 member companies span the agricultural supply chain, including country elevators, feed mills, exporters, merchandisers, futures brokers, end users, and allied industries that support the industry.
